  • U visa applocant CAN be deported

    I called 3 lawyers today, and i ask them can I be deported while U visa application is pending. They told me Yes, U visa application can be also wait aboard, so while
    they dont decide are u on waiting list or not, U can be deported to your country. I know that this is frustrating but im writing this so you guys can be carefull. We help police, some of us could DiE that day. And we dont have ANY ANY protection. So sad...

    Yes Bob, everyone without legal status now can be deported, but I also asked some lawyers and they said when they see you are u visa applicant and you didn't broke any other law, they unlikely put someone in removal proceedings because they don't want to use their limited money for those low priority people.

            I actually posted about this before. It used to be that u visa applicants during Obama are low priority. USCIS has said that is still the case. Anyone that is a witness in a crime is meant to be low priority. The new policies state that any removable alien will be priority. So if you entered illegally or break any laws you are removable. Yes u visa offers waivers but they argue that you are free to wait abroad. If you are far off getting a decision the judge is more likely to rule that you leave. Don't think they are targeting u visas though. Only if you are arrested or have an existing order of final removal, then definitely stay under the radar.

              Its removal order back in 2003 when they catch me at border, after that no criminal records. Still I'm worried a lot like I have done something wrong. Now I'm helpless.

                Best advice, don't draw attention to yourself. If you aren't arrested they aren't going to be coming for you. If you aren't working illegally then you may be ok. Stay under the radar. Quite frankly any run in with law enforcement is going to cause you issues. If you drive obey all rules of the road. Don't give any branch of law enforcement a reason to stop you. This is going to sound harsh and my apologies but this is just a fact. If you speak any other language try speaking English in public. Especially if you live in a border state. Keep any state issued ID on you. Anything at all that won't make them ask you for further citizenship info. Before anyone comes at me...I am black and I speak English and my name sounds American. I used that to my advantage. I got state ID and I try to affect an American accent. It is rare people ask where I'm from but when they do I don't lie. Most assume I have all my documents and don't question anything.

                  I hear you, that's how I survived this long in America. Now I'm carrying drivers license from Illinois which says it's not valid for identification n that's bothering me living in newyork.

                    Well hopefully you don't have much longer to wait. Some states allow you to get a license with u visa application. Don't know if NYC is one but you can look into it.

                        I tried in Arizona dmv they didn't give me said come back after you get approved but if someone has a work permit that will definitely get him/her ID or a driving license

                            N.Y is known for imigrant friendly state, so about your situation you can always call or make an appointment with a dmv agent, I think could be a worth of a try

                              hi i apply to u visa 2018 and i find out ,I won the diversity green card lottery, but my question is, as a "u" visa applicant, do we have any status or we don't have any, because with the diversity program, if you are in the states, you have to have a status ,if you don't, u might not get it the green card , I came here with a tourist visa I overstay about 3 months,after I apply for u visa,if you have any knowledge about u visa applicant status please share
