U Visa Applied Feb 10th

  • U Visa Applied Feb 10th

    Hello Guys,

    Have applied to U Visa just this week. I am currently on F1 visa.

    Once DA is approved and an EAD is issued, What would my status be ?

    If my F1 expires by then, what are the options I have ? Also whats the wait time cuurently..

    Hello Bob, just be very patient and prepare for a long long waiting... right now people wait 2.5 - 3 years for DA, those who applied between 2014- 2015, and it may be totally different in your case since you just applied and each month the backlog become longer and longer.

      Hi Bob,

      I was in the same position back in 2014, when I applied for U visa I was on F1. My attorney told me that once you apply for the U visa u fall out of F1 and I am no longer on F1 status. She told me if I want I can continue my study as F1 but technically I fell of the F1 since applied for the U visa. So, I stopped studying since it was very hard for me to pay the tuition at that time and I just kept waiting on U visa. after 1.5 year I got DA which was in FEB 2015. Since than I am on DA. While being on DA I do not have any status. But I can work, can get DL and file tax. Basically DA is just a protection against deportation and practically you are qualified for the U visa. But still after getting DA they can change their mind and can deny you U visa. Once you get Denied than you do not have any option left. That is my story.

      I am on DA right now and working. You can consult your attorney for better answer. Hope this helps.

        Thanks for your response. But F1 will be valid till you get a U visa( as long as you do whats required under f1 rules). DA and EAD wont change your status. Only once U visa is issued, F1 will be void.

        This is what I know from my attorney and the internet .

          I am not sure about the F1 thing yet. I just did what attorney suggested me. Thanks for your reply.

            Hi Bob did you receive any letter from usics which is stating that your case is received and it has your file no (case no ) in it do let me because I applied in 15 Jan 2017 didn't get case recieved letter from uscis .
