    Applying for H1B .. U Visa might be approved in December 2017 CONFUSED PLEASE HELP

    Hello

    I am on F-1 OPT status right now and applied for DA might get it in FEBRUARY 2017.
    My question is my employer wants to apply H1B visa for me if I get approved for H1B this year I will be in H1B status from September 2017 and if I get my U Visa approved in December 2017 will my H1B be cancelled? What will be my visa status?

    What do you recommend.

    U visa case recieved : Feb 7 2014
    DA APPROVED : March 2015
    Applied for DA : Nov 2016
    Case recieved for DA : Nov 8 2016

    All suggestions welcomed.

      No I didnt apply at that time because I had F-1 and valid opt.Now my opt is about to end so I am applying for DA EAD.

        H1 and U visa has it's own pros and cons. Since you have already pre approved for U visa you won't be out of status after expiry of F1 OPT plus you can continue or go for any job of your choice once you get DA EAD. Your employer petitioning for H1 is subjective and unsure of PERM certification for EB GC. In other hand you will be able to file for AOS on your own after being on U visa 3 years. Travelling on U visa is restricted where as on H1 you can travel multiple times
        Once you have stamping. I would prefer U visa if i have a back up of any other visa.

          So,If I am approved of H1B and After few months I got my U Visa card .Which status will be on?? H1B or U visa? Can I have both visas?
