  • Question about DA-Student on F1 visa

    Im a F1 visa holder and on DA for U visa i was approved for DA on Oct-2016. But my lawyer didnt tell me if i can stop going to school. He said its up to me but if i stop then i will be out of status until i receive the actual U visa. My question is can i stop going to school until i receive my U visa? Could i be denied for u visa even when im on DA? Im spending so much money for holding my F1 visa. My husband said keep going to school but im so tired of going and spending so much money.

    Go to school but also apply for Deferred action category C-14 EAD. Whats your timelime?

      Thank you for your reply. I havent apply for the work permit but my husband received one. Maybe i should aplly anyway. I dont know what my time line is. As long as i keep maintaining my status then thats it i guess until i receive my u visa which probably isnt for another 2 years

        I am telling you 100% that if you have approved DA for u visa then you don't have to continue your F1. My cousin got actual u visa when he was only on DA. He was F1 student before DA. After getting work permit through u visa DA , he left his school then he was only on DA until he got actual u visa. But when did you apply for u visa? When was your biometrics. Please tell me your timeline.

          Applied On june 2012. Biometrics on August 2012. Then approved DA on Oct-2016. So im still in school thinking in case if we dont get the u visa then at least im on F1 still but seriously wasting money and time like this is so crazy to me. But i guess we will have to wait another 2 years for the actual visa

            Did they skip your u visa approval? How come you applied june 2012 and they took so long time to give you DA ? Now they are working on September 2014 for DA. People are getting u visa approval until February 2014. What was the wrong? Can you explain it to me?

              Sorry for taking long. Its my bad its 2014 not 2012 i didnt realize sorry. But somebody on DA get denied? Im so nervous but im going to take your answer and quit my school. I hope i get my u visa

                check with your lawyer

                Please talk to a lawyer experienced in these cases first before going out of student status. The "first look" approval that gets most people the deferred action approval with authorization to work as they wait for the final u visa approval is only 1st step.

                Before final approval of u visa it is my understanding that the application will get looked at again at that time. If anything a person stated as true on his or her initial u visa application and waiver of inadmissiblity application-if there was one- is different at the time of looking at the application for final approval, that could slow down or complicate the final approval.

                I am thinking specifically of the question on the i918 that asks what is the applicant's current immigration status. If the answer included something about student visa status, and the applicatant is no longer in student visa status, then that answer on the application is no longer accurate. There may be answers on the application for waiver of inadmissiblity that will be affected too.
