U visa holder's spouse

    Hi.

    I received U visa yesterday which was taking 3 years in full.

    My husband is under DACA for 4 years and we got married this year.

    Does anyone know if he can change his status to U visa?
    Or there is nothing he can do at this stage and wait 3 years to apply permanent residency with me?

    Anyone know about it, please let me know.

    Unfortunately NO ma'am, you can't include your spouse for U visa if the marriage not happened prior to your filing date. You will have to wait till AOS.

    Appreciate if you can share your U visa timeline

      Hi, again.
      My U visa timeline

      1. file U visa I-918 : Oct.22. 2013
      2. got receipt of U visa I-918 form : Nov. 04. 2013
      3. fingerprint : Nov. 20. 2013
      4. U visa I-918 application approved / deferred action : Aug. 15. 2014

      5. received U visa & 4 year work permit : Nov. 3. 2016 (I received it yesterday Nov. 9 though, the date is printed on the letter)

        Hello,

        some lawyers say no ( as per old rule , you can not) some lawyers says yes (rule has been updated) but still there is confusion and mix answer from diff attorney.....i am facing the same situation.
