    I have received a letter from USCIS for my file transfer to Nebraska Service center. I applied on August 5th 2014.
    I request you to please answer my question Mr. Shah.
    If the case is sent to Nebraska does that mean that its nearing a final decision in contrast to vermont.
    Please respond.

    My husband applied on June 3rd 2014, and it was not transfer to Nebraska. As far as I am concerned (and I know you want his answer and probably not mine), there is no special treatment if your case was transferred to Nebraska. Also your case will not be delayed because it was transfered. It only means that as we are getting closer to October 1st, all pending cases (being processing on Vermon and on Nebraska) will get processed faster than last year. Cases will be processed as their being received. My husband's case would be processed before yours, and many other cases will be processed before my husband's.

        USCIS approves 10,000 U visa cases every year.
        However, they also process cases and place them on a "wating list" when the yearly cap is reached. You will be granted a deferred action, and you will be able to apply for a work permit until your actual U Visa is approved. Until May of 2015, the cases were processed (placed on a "waiting list") within 12 months. After that, the cases are taking more than 28 months to be processed. To obtain the actual U Visa takes (from the moment you apply) 3-5 years if you applied in 2014. If you applied in 2015-16 it will take a lot longer. The Vermon Center and The Nebraska Center are trying to work together to make the processing time faster, nevertheless, the cap of U Visa of 10,000 has not changed.

          Hello Mr. Perry,

          My application was received on August , 11 , 2014 ...but there is no change in the status of my case , since the time i have applied.
          Any idea when will i get a decision on Pre approval or DA letter from them.

          Also if I am out of status , will that impact my EAD application , and after EAD application , can u stay out of status till u get u Visa.

            What do you mean with?

            If neither your case or nmhrk were approved and placed in DA. Both from back 2014.

            I wonder if USCIS work on cases through out the year or just after Oct 1st until Dec.

                  What I meant is cases were being processed within 12 months. So if you applied before or on May 7 2014, your case was processed normally within 12 months. Lets say a case filed on May 7 2014 was put on a waiting list on May 7 2015 (12 months) after that, good luck!
                  So far 27 months and still waiting for a response....

                    My husband applied Sept 29 2015 ,got RFE in May 2016 just got DA letter Sept 16 2016. It DOES not take more than a year to get approved , he is currently in MX but lawyer said new law will let him parole in on DA and wait in USA until a visa number becomes available.

                      Hi Puebla, I was apply in May 2016, what do u think is it going to be same 12 Monts ? Because i see here many people saying more then 2 years...
