  • why our lawyer's are silent on delay ?

    I wondering-
    why our lawyers are not inquiring about delay in reviewing new petitions ?
    At least they ask uscis.
    I read somewhere that there
    law Congress has created - EAD after 90 Days of filing petition
    Now uscis is accepting I 765 on DA in advance But our lawyer says to wait for DA letter.
    It helps to save our time to get EAD if we apply in advance

    They are not silent actually it is the cap which is causing the delay. There are only 10k allowed for 30k application. This is why we have started a petition to change this, please have maximum of people sign on this https://www.change.org/p/u-s-senate-...-000-to-30-000

    Note that just like VAWA, the USCIS regular phone number will not give you updates on U visas because of confidentiality reasons and other reasons.

            This is about EAD after 90 days of application.
            10000 cap fixed as per crime rate in year 2000 when law created.
            So, cap should b raised as the crime rate goes up in the country

              I completely agreed. I undertand that we want to raise the cap on U visa. However, lawyers should be able to ask (not particularly for a case) why USCIS stops granting DA, or when are they going to resume granting them. I also understand, DAs are given per they discretion, but come on! Thousands of lives are pending on the DA just to have at least a "normal life"

                    U Applicants Have Successfully Sought Redress in Federal Court to Receive LongDelayed EADs Under Current Law and Regulation

                    Sanctuary for Families, in partnership with the law firm WilmerHale, prepared individual federal complaints on behalf of several clients with pending petitions for U nonimmigrant status seeking to compel USCIS to issue EADs to those clients.

                    Rather than litigate the question in the District of Vermont, USCIS offered to settle each case expeditiously, offering an immediate grant of deferred action and work authorization.

                      knowing Timeline is not enough for we all

                      we need Defered action

                      if we get DA after 90 days of filing petition that is blessing for us.
