u visa Cap is 10000 but if USCIS don't issue more DA then What we can do ?

    Friends,

    I am also waiting like you. and I wish we all get at least EAD.

    We know they stop issuing DA after May 7, 2014 - WHY ?

    in current situation just I am thinking differently.

    Qtn : Is there any cap or limit for DA ?
    Answer : No, there no such cap for DA

    Qtn : If USCIS don't issue any DA then, What we can do ?
    Answer : nothing , we can not do anything DA.

    We all know, U visa cap is 10000 per year. it means they can issue U visa up to 10,000 if they have approved or approvable petitions.
    After the U visa cap of 10000 and after having approved or approvable petition, If USCIS not issue any U visa then ?
    yes, we can challenge them in federal court, But we can not do anything or DA. because there is NO Cap.

    Day by Day more and more U petitions filing and they over loaded.
    In my opinion, USCIS is over loaded not only bcoz of u petitions, but in all other category they are getting more and more petitions.

    Trouble is, U visa is on low priority and they are not taking care of u petitions.

    Last 2016 Cap they hard issued U status petitions filed up to july 2013. ( this is approximate figures )
    It mean- they stop around July 2013 for cap and
    - they stop at May 7, 2014 for DA.N
    If you check Quarterly Data for new petition filing, from June 2013 to May 2014 - they have app.26,000 petitions ( 6500 petition/ Qtr )
    and they issued DA up to May 7, 2014 so they have issued more 20, 000 DA.

    In my previous thread I told they have issued DA more then double the cap,

    when USCIS has work load in other category and they has more then 20000 petition ready for Annual cap of 10000 ( 2017 cap & 2018 cap ) , then why should they worry.

    It's true, they are not working on u petitions, just think, I wish every body get DA and EAD ASAP.

    I got my number it looks like my case is going to be approved on 2019. You can check your one..

        My number is more than 35000 so mine will approve 4 th FY. In 2019 if the cap will be still 10000.

            Yeah U visa applications are not top priority for USCIS looks like. Actually the closer the elections the slower the processing of U visas. I think their top priority right now is to process naturalization applications. It would make sense to add voters for the upcoming elections.

              I applied in September 2015. What is about you? Then I I can predict that when your one will be available. I have been watching the u visa cases since 2009. So you can trust me. In front of my eyes so many people got the approval since then.

                This is not less priority. Just imagine one person applied for u visa today. So they are going to take the biometrics then they will put deferred action then issue the ead card then actual u visa approved then again ead card for 4 years. After 3 years green card apply then interview for that.. And every u applicant has so many dependents over here and back to their home so in all together this is just too much work. Some of the people they got the actual u visa after 2 years, without any deferred action. Only thing is making difficult is 10000 cap. If it will be 20000 then it would be perfect. But as long as I know they are not increasing the cap. U visa is for victims. If they cap is 20000. Then the whole percentage of crime in USA will be increase. Which is shame for USA. So wait until October so many people will get sudden approval... Hope you will have your number by this year

                        I applied on August 5th 2014. I DONT have any dependents on my file. When do you think I can expect DA and get my EAD? Suggest.

                          I think you are not going to have any DA. It doesn't depend on the dependents.. I mean how many family members you have. But as I said your approval wouldn't take more than 1st October of 2017. All the 2013 cases are sorted out, even of early 14. At least they have DA or approval. So be patient. You are almost there.

                            u talking people got actual approval after 2 year........... u talking about may b 2009 to 2011. Do you know which year is this ?......It is 2016.
                            u said u watching data since 2009.....u should know every year more and more peoples filing for u visa.
                            Day by Day situation is verse and verse and u said this is not less priority........ .....

                            why they didn't issued and DA or RFE ?
                            why date MAY 7 2014 stuck since last April ?
                            Who will get sudden approval ? All ?
                            Can u tell us. Approximately, how much DA they already issued.

                              The cap is not increasing.. For sure. I put a link please see that how many u visa is pending right now after denying and after approving from 2009 to 2016 still there is 37000 u visa cases are pending after 1st October of 15 cap. so if you applied in15 you will hear something in 2019.. If you apply in 14 you will definitely hear something within 17 based on 10000 cap.And deferred action is not coming for everyone bcz this is not mandatory for uscis. U visa is a free case. This is a good chance that you can get some benefits through this visa. You can be an immigrant from a non immigrant. Don't wait and cry for deferred action and wait and pray for the actual approval. I can understand the feelings but this is the true fact.
