Applying for u1 visa while on h1b

Hi All,

Thanks for giving me this opportunity to post my concern here. If any one can put more light that would be great, as no direct answers on them I found on net.

I'm on h1b, valid till next year and extension valid for another year then. I'm eligible to apply for u1 as per the incident happen to me seven years back.

Concerns I've are,

- What status I would be if deferred action/status is granted while I am on h1b.
- If I am on h1b, status would be defer putting me in waiting list does it automatically cancel my h1b?
- Can I go back to h1b from U1 while on defer status or after having U1 visa?


Also if any one out there had done COS after 3 years of U1 visa to Greencard?

H1B to U1

First of all, H1B is best option to get GC

But, for backup u can apply for U1 ( if u or your lawyer suggest your case is Good enough for u1 )

u might b knowing, rite now, there is long waiting, so even u apply for U1,.... u have to wait couple years for deferred action.
on deferred action u have no legal status so it will not harm to your H1B status.H1B will not cancelled bcoz of deferred action.

as per current work load or pending application for U visa, u have to wait up to 2020 or later to get regular u status.

Once u get your u status, your H1B can b cancelled ( make sure with lawyer )

before u get your U status means up to 2020 u can b on H1B and need to worry about

u can travel on H1b , u know that but once u get U status u can not travel for 3 years bcoz it is risky.

U can get U status on your case bcoz they need victim to convict the criminal but remember for GC ( after U status ) u need to apply on humaterian basis.

we don't know any body got GC after u status and even what is approval / denial rate, so far

so apply for u Status if your case strong enough. but try to get GC while on H1B............. otherwise u have long waiting option for GC

Thank you very much. I wish I would had known about U visa back 7 years. I'll keep u process running as backup "in case" scenario. Didn't know about humaterian basis when applying for gc based on u1. I'll check on that as well. Thanks again for clear answers.

I have same status as you. I am also on H1b valid until next year and I am eligible for U visa.
Have you applied for U visa? If yes, what is your timeline?
