    HI,
    I and my wife have a Green Card and we have a son who is USA citizen. My wife and kid have gone to India for taking care of my Mother-In-Law who had a surgery. My wife is been there for more than 5 months now. But she wants to stay for few more months before her Mother is recovered well enough. Can she stay for more than 6 months..??
    Anyone with information on this please respond.

    We have a residence home in USA and my wife has an active bank account and valid active drivers license.

    I have gone through the USCIS website for information on this and this is what they have:-


    If anyone can confirm legally that she can stay for few more months, then we can plan accordingly.

    In the situation at hand probably yes because you have an extraordinary circumstance. I will recommend if you get inside the US to actually file the form I-131 re-entry permit and even before approval after fingerprinting you can leave (and thus obtain two years of allowable stay). I also recommend you keep a very good documentation of the situation including the medical records. Although you might be able to keep the greencard, it might not count towards the citizenship time. I will recommend calling us then to assess your possibilities at 510 7425887. Good luck and hope your wife gets better!

        It is a case by case basis. So common sense will usually dictate such cases. You need to show that there were extra ordinary circumstances which prevented you from coming back.

          Why would you stay so long outside when you have a greencard? I do not understand that! We are waiting so long to get one.
