  • U visa waiting time based on USCIS data

    Hi all,

    Friday USCIS posted the updated data set for U visa applicants they received and processed. I did a quick calculation on the waiting time. Just to share so that some people might find it useful.

    if you apply in 2014, waiting time 2-3 years
    2015, 3-5 years
    2016, 5-7 years
    2017, 7-8 years

    (waiting time starting the date USCIS received your application)

    This is the waiting time for USCIS to approve your application, deferred action might come half a year or a year earlier than this.

    if anyone wants to do the same calculation, here is the link and data

    Hi Ckrabbit,
    Thank you for the hints. Btw I applied in March 2015. It’s be 30 months for me. When can I expect my DA according to your calculation??
    U visa Application date: March 10, 2015
    Biomatrics Done: April 20, 2015
    RFE August 09, 2018
    Waiting for DA.

      @ckrabbit > you did a good work but USCIS math seems to be different if 2009-2018 calculated according to quota 96,000 approve by now and if you remove refusals approx 22k total 116,000 applicants should be cleared with U visa that is till Jan 2015.

      Their motto became first come last serve.
      AND
      They reserve right to waitlist forever or refuse the service.

        they will start processing 2015 applications from 2018, but only 2-3k, since your date is almost the end of the 2nd quarter of 2015, I would say, about 15k applications from 2015 are before you... which, your case might be approved in 2019 (last draw) or 2010 (first draw)... usually, you get your U visa about a year before that. Just my guess from the calculation. hopefully you will get it earlier!

          I don't see how you came with that conclusion, from 2009 to 2014 they already had over 110k applications, which, now they are reviewing 2014 august, matches perfectly... fiscal year is from oct to sep next year... you actually proved my calculation...

            Hallo am from 2015 too, so are you saying they get DA in 2018, 2019 or actual you visa. Thank you.

              the calculation is for visa decision, and DA is usually half a year or 1 year before that... depends on what month of 2015... it will defer from late 2018 to 2020 for the actual visa approval.

                  I have applied July 2014 and DA Approved October 2016. Should I expect my U -Visa this fiscal year or have to wait 3 more years as per your calculation?

                      I applied in June 13th 2014
                      Got DA on July 2016
                      Still waiting for the Actual U visa, for over 3 years now and i do not fore see receiving actual U visa in my hand by June or July 2018 if USCIS continious the 2017 policy of staggering the approvals. this means that total wait for me will be 4 years from the date of application ( if i get the actual U visa in June or July 2018) am i missing something in your calculation??

                        So my husband submitted his application
                        Sept 2015
                        He got the DA letter sept 2016
                        So how long will he wait for the actual U visa ? FY 2019 -2020 ?

                          the half a year or one year that I said between DA to actual visa is not from my calculation, it is based on some reported cases online, USCIS didn't specify the time between DA to actual visa... since you already got your DA (congrats!!), my understanding is that they already reviewed your application, you are just waiting for the visa to be available, which is what I calculated.

                          In my calculation, the last about 10k applications from 2014 should be all granted visa (if approved) in 2018 FY. My guess:Your case was June 2014, not even the last quarter of 2014, if they do not change the speed (about 3500/per quarter), you should fell into the first quarter of 2018 FY (oct 2017- dec 2017) . However, I also heard the process time varies even after you get approval/ visa available... it's hard to say when exactly you will get it, my calculation is just based on the data they published.

                            That is a really fast case to get to the waiting list!! Both Vermont Center and Nebraska Service Center are reviewing applications from Aug, 2014!!

                            the calculation is for when the visa is available. if my understanding that, USCIS is doing this on an first come first serve policy, which they stated, is correct, and your husband's application is Sep 2015, then yes I think it will be late 2020.
