    Hey guys I'm really worried and feeling depressed please share your experience if you related to mine is going to help me a lot immigration send me a letter March 9 requesting evidence the time limit already pass one month and by the time I send it as going to be 2 months are they going to deny my case ???

    I'm sorry to hear that. I honestly don't know what happens if you send it late. We sent the requested document on time (RFE on December 6th, we sent it on January 17th 2017), but so far we didn't hear from USCIS (over 5 months waiting for a response).

    It's funny how they give us a limited time to respond, but they can take excessive time to respond. It's not fair.

    Did they give you 90 days to respond?

      USCIS FRE response time frame is 30 to 90 days depending on the type of petition, pleask ask your attorney how long is for U Visa.If the RFE havent been submitted on time, they can officialy close the case due to abandonement with the option to file a Motion to Reopen or Reconsider, which also has to be file within certain time frame. Requesting to fils a Motion to Reopen or Reconsider is your attorney's job and he has to file it free of charge for you, if late response to RFE is his fault and you have to insist on that. Your aattorney can also attach a letter for USCIS explaining while ypur late response was justifyable, why you had a reason to be late, just explain in details. USCIS are human and this is humanitarian petition. Its best not to be late because they can close ths case but lawyer must quickly file a Motion to Reopen. The lawyer should not be late with RFE, thos is his job. If you were late with RFE due to your own reason because you took long to obtain that RFE documents, the lawyer must explain in official letter to USCIS and do this BEFORE they close the case. If they close the case due to abandonement, the lawyer must quickly file a Motion to reopen. There is time frame to file that motion. If the lawyer is late to file within that time frame, the case can be close. This has to be taken very seriously, no reason to worry though. Just talk to your attorney.
