    H1B to H4 EAD

    Hello Shah,

    I first came to USA on H4 and worked on H1B visa from Oct 2013 to 31st July 2015.My husband is on H1B visa for past 6 years, with an approved I-140 from his current employer.
    I would now like to convert my H1B to H4 EAD. Would appreciate if you could help answer couple questions on the same

    1. Till when should I be running my salary to maintain a valid status - till receiving H4 receipt notice or H4 Approval?( I will have my pay stubs till 15th Aug'2015)

    2. I heard that it takes 3-5 months of time for H4 approval and an other 3-5 months for H4 EAD approval. Can I go for consular processing outside USA(Canada/Mexico) for H4 approval instead of applying for a Change of status(COS) from H1B to H4 to reduce the first 3-5 months of time? and then apply for H4 EAD after coming back to USA with H4 approval?

    3. Can I travel India(home country) while H4 EAD is in progress(after H4 approval)? Have travel plans to India for 6 weeks in October

      It is taking only around 3 for change of status to H4 and around 3 weeks for the EAD. You can also travel and come back on H4 and then apply for EAD. Please call us at 510 742 5887 if you need help in the process or for a full consultation.
