H1-B to H4-EAD

    H1-B to H4-EAD

    Hello,

    I am currently on H1-B and have valid H1-B until January 2017. I am considering to move to H4-EAD as it is getting really difficult to find a new job and I am looking for a change eagerly as I am commuting a lot. But,I am looking at the flexibility that EAD gives just like anyone else. But I have some questions regarding this process:

    1. Can I file H4 COS and EAD concurrently?

    2. If so,both H4 and EAD will be approved together?

    3. Will there be any employment gap?

    4. What are the time lines of these 2?

    5. Since I have H1 until 2017, will there be any issues with moving to H4?

    6. Later time frame, can I come back to H1 with out any issues because I am already in quota?

    Thanks in advance for all the help, we the immigration community really appreciate it.

    To answer your questions

    1. Yes in fact it is good to do concurrent filing
    2. H4 COS take around 90 days and the EAD around 2 to 3 weeks later
    3. Probably a few weeks
    4. See above answers
    5. No issue on H4
    6. There might be issues but if the quota is still there no problem
