F1 OPT to H4 EAD

  • F1 OPT to H4 EAD

    Hi
    My wife is on F1-OPT(EAD) and is valid till Jan 2016. She has got an offer from a company and would be taking it up. However we are planning to convert to H4 EAD .

    My question is would she have continuous employment while we simulataneously apply for I-539(change of status from F1 to H4) and I-765( H4 EAD Application). Would there be a single decision on this change of work authorization or would she be out of status while H4 EAD application is adjudicated.

    Dear Sandeep,

    Many are asking this question, it will be hard to speculate on the actual time of processing. However, since during the process she will still be on OPT, she will be able to work and since the H4 will probably be approved before the H4 EAD, there might be a lapse of few weeks.
