H4 EAD & change of employer

    Hi,
    I have already I-140 approved from my current employer. So my wife is eligible for H4-EAD.
    I'm on my H1B extension beyond the 6 year limit.
    If I change my employer, will my Wife's EAD still be Valid ?

    Probably yes because you are beneficiary of both provisions I 140 or ac21. Having said that, if the i140 is cancelled before transfer then both and your wife might fall out of status. If you want a specific consultation or help on your case, please call 510 7425887

      Can you Pls clarify the following -

      1. what you mean by i140 cancelled ?
      2. what happens if the employer revokes i140. but i'm still working with the new employer on H1B.
      3. what happens if USCIS revokes i-140.

        2. Well it will probably follow the same rule as under AC 21. It will be valid until it was granted and no more extension.

        But it will be hard to ****yze until it happens. Since the law is new, we don't have any precedence to ****yze.
