H4 to H1 COS

Hello,

i am on H4.My H1 is approved in July 2014 and cos is denied as I was in india at the time of filing. Please suggest me with the following questions

1. Can I file cos(amendment) for H4 to H1 instead of going to stamping to India.
2. Am I cap exempt in future as my H1 is approved even though I dont use my H1 now and I dont get it stamped in india or file cos at present.

You can apply for H1B transfer while on H4 EAD. Since you are on H4EAD work permit, you can keep working on H4EAD status until your H1B transfer is finally...
