Hello Mr. Shah,
I am an H1B visa holder and waiting for my priority date (Nov'12) to be current before I file my i-485.
My spouse in on H4 and enrolled in SJSU. She just completed her first semester.
She is contemplating switching to F1 so that she can avail the CPT (9 months later) and eventually the OPT option.
Given the current visa status, she would be eligible for the new EAD for H4 rule (IF IT BECOMES A LAW).
Do you think she will still be eligible for the rule if she switches to F1?
