  • H4 to J2-does it hamper my priority date which is current?

    I have a I 140 approved and my priority date is current.My employer decided not to continue with the sponsorship of I 485.Currently I am on H4 visa.My husband will be converting to J1 as his new employer doesn't sponsor H1B.If I change my status to j2, will I lose my priority date in case another employer decide to sponsor my green card? Is converting to F 1 a wise decision than to convert to j2? Thankyou!

    Actually, if the I-140 is still valid and not cancelled, you can use it to extend the H1B even with another company. As for the the J1 and J2, if it is subject to residency it causes many problems. But YES you can keep the priority date even I-140 is revoked unless there was fraud involved.
