    Hello.. I am currently on H4 visa and my husband is on H1b visa. I want to change my status from H4 to F1. The problem I have is my husband is not ready to support me with any kind of documents as we are not living together but not divorced. Currently I have my I797 valid till 2016 but doesn't have stamping in my passport. Do I really need my husbands H1b, I797 and passport copies for my F1 visa processing which I do not have with me??? If I need those documents, please tell me in which way I can get them or please suggest me with other alternates for my visa processing.

    Probably yes but you can try a FOIA on your name and receipt number you should be able to get a copy of the approval notice since the H4 belongs to you not your husband. If you do a consular processing you might not need it. Feel free to call us at 510 742 5887 for a full consultation
