  • I94 Validity

    Hi,

    I have a question on my I94 dates and validity after my recent entry to the United States.

    I had been on vacation to India in May-June and returned on the 3rd week of June. When I reentered the US, my passport was only valid until 23rd Jan 2016. My approved H1-B petition is valid until 29th Dec 2016.
    The officer at immigration initially stamped my passport with an expiry date of 12/29/2016 but later noticed that my passport is only valid until 1/23/2016, so he scratched out the date and over wrote it with a new date of 1/23/2016.
    I have 2 questions on the above.

    1. I went online to the DHS website and downloaded my most recent I94, the online version has an expiry date of 12/29/2016(but my passport stamp has 1/23/2016). Should I contact US Customs and Border Security, to correct that?

    2. If it gets corrected and the correct expiry date if 1/23/2016, am I required to leave the country on 1/23/2016 and get a new stamp on my passport(I have renewed my passport after my return to US).

    Appreciate your response.
    Thank you

    1. Yes you should contact them to correct;
    2. You do not have to leave to correct, you can just file an extension.
