  • H1B Transfer in 8th Year

    Hi Attorney Shah,

Thanks a lot sir for the radio show and your help towards the community.
    I have a question regarding H1B.

I'm with company A for the past 8 years. My H1 started in Sept 2007 and completed 6 years by 2013. I have I-140 approved and my H1 was extended until Sept 2016. I'm planning to change my job to company B now. I've read that new H1 from company B would be valid for 3 years from now as there is a valid 140 from company A. Could you please confirm?
If company A revokes my GC later, Would I still retain my Priority date? Does this impact my H1B status??

    Thank you.

You are welcome and thank you for the kind words.
As long as the I-140 is valid when the transfer is filed, you should be ok. But if cancelled, not only you wont get the transfer but you might lose your possibility of a job with A. Be careful. If transfer is done and I-140 cancelled later, you might be ok. And yes, you can keep the priority date, even if I-140 is cancelled. Do not make a move without talking to an independent lawyer.
