    Hi,

    I was working for an employer and went into FML (starting 1 Sep) and didn't have pay stubs and I have left the company after 4 weeks into FML (23rd Sep). So I don't have pay stubs for that period. And I have an consultant now wants to process my H1b (Nov 24, 2 months after FMLA). My I-94 is valid (Valid until 2015) and I-797 is not revoked. so what will happen now with new H1b petition ?

    Well you can actually either put a complaint against the employer with the DOL or just do a transfer of employment and consular processing. Make sure you do not pass 180 days after the termination. I will recommend calling us at 510 7425887 for a consultation.
