  • H1B Transfer to a new company with RFE

    Hello All

    Hope this post finds everyone in a good condition. I got laid off from Company A on January 31st, 2013. The company promised me that they would report to USCIS about my suspension only after March 2nd week which they did on last friday. So, I started searching for new job and I got one in February 1st week. The new company B (which is very slow in doing things)have applied for an H1B-transfer last week to USCIS and we got an RFE last week. I still don't know what is the RFE about, will know it in this week.

    Note: I don't have payslips from January 31st to now

    So my questions are:
    (i) If the RFE is about my missing payslips since one and half month, what should I do? Is there any way of explaining my situation to USCIS people, if yes will they consider it?
    (ii) Will I get my H1B transferred successfully?

    Please Help me in this matter, I am in lot of tension I am understanding what will be my future?.

    Until we know what is in the RFE we cannot speculate. I will recommend you do a consular processing in case, the employment was terminated before the transfer. It will be hard to answer unless we look at the RFE and know more facts. I will recommend talking to the company attorney or call us at 510 742 5887 for a consultation.

      Thank you very much for your reply. I have two questions:
      (i) What do you mean by consular processing?
      (ii) What help can you/your agency can be of help to me because my transfer has been applied by the company attorney, so how can you step in to help me?

        2) We can help with the RFE or at least guiding you.
        But you should rely on the company attorney because we have limited facts.
