Just filed an H1B transfer and extension through premium processing and I wanted to know how long I have to wait to get an answer. My friend told me they have to answer within 15 days but I am worried because the current H1B visa is expiring on February 15, 2013. What to expect?

How long is the H1B processing time? Is USCIS not supposed to answer in 15 days?

Indeed under premium processing, the USCIS has to actually make a decision within the 15 days. In fact, if the case is well prepared we have seen cases approved within couple of days after filing. However, if there is a RFE (Request for Evidence Issued), then the 15 days starts running when you answer the RFE.Shah Peerally is an attorney licensed in California practicing immigration law and debt settlement.
