Does existing visa gets cancelled immediately upon issue of new visa

  • Does existing visa gets cancelled immediately upon issue of new visa

    I am planning to travel out of country to get an F1 visa stamp. However my H1B visa is current and I am working. Does that mean I have to terminate/notify my employer before traveling out?
    Is it possible to get the F1 visa and then inform the employer about the intent to leave employment or is that not correct if H1b visa gets terminated immediately upon issuance of F1 visa?

    Would really appreciate a response as I am trying to travel and request visa appointment.

    Your question can be interpreted two ways:

    1. If you did a change of status from H1B to F1 status, yes the H1B terminates automatically.
    2. If you did a consular processing then only when you enter on F1 it will terminate.

    In both cases you can always "revive" the H1B as long as you have years left. If it is confusing, I will recommend you call us at 510 742 5887 for a full consultation.

      Thanks a lot for the response Mr. Shah. Appreciate the help you have been extending. From consular processing I am guessing you mean filing change of status from within US. This helps, I will call your office for further consultation meanwhile will have a discussion with the ISSS office of the university.
