  • How soon to file the Labor Certification after moving to new employer (H1B six yrs)?

I am on the 6th year on my H1, I have changed my employer right now, how soon should I be filling the LCA and I-140?

  • #2
You should file asap. It is common to have the labor filed before one year of the expiry because it will allow you to renew for one year in case the labor is pending for 365 days. However, if you should still file even if you are less than one year. You might be lucky and have an I-140 approved quickly which will allow you to obtain a possible three years extension. You also need to make sure the sixth year does not expire on you. In this case, you might want to take a trip outside. When it comes to such situations, we highly recommend having an experienced lawyer handle it. Our law firm has handled many similar cases. Feel free to call us at 510 742 5887.
