    Transition from F1 to H1b thru Cap-gap extension

    Hi,

    I am a business student eligible for 12months OPT.

    My OPT started on 4th May 2015 and is valid till 3rd May 2016. Recently I found a company who agreed to file my H1b, however, once concern they have is that only if H1b lottery results are received before my OPT expiration, I will be eligible for cap-gap extension.

    I was told that for H1b filed in April 2015, the results were announced on 27th April (for premium category/students quota) and rest all were announced post 11th may 2016.

    Can anyone suggest, in my case, how I could ensure that I am still eligible for cap-gap extension and is there any idea what timeline in USCIS planning to provide results.

    If your OPT passes April 1 2015, you are eligible for cap gap provided the case makes it to the lottery. You might want to look into STEM extension if available or go back on I-120 student F1
