    Masters Engineering OPT to EB-2 Green Card application directly. EB2 visa is Current

    Hi,

    My employer is ready to apply for my Employment Based Green Card in EB2 category. I recently started my OPT after completing my Masters in Engineering Management. I was working for the same employer on my CPT. I have never applied for H1B visa, as 2016 cap has already reached I can only apply for H1B for 2017 Cap. My question is.

    Is it possible to directly apply for EB2 GC without applying for H1B?

    As EB2 is current for my area I am hoping I will get an EAD before applying for H1B 2017.

      Yes it is possible but it can jeopardize a future extension on student visa. If you are not born in India or China or your spouse born in a different country than India or China, an EB2 might be helpful to just adjust status. I will recommend calling us at 510 742 5887, before you make any further attempt to file.
