  • Reports of many approved I-140 being revoked

    Many individuals have been calling the Shah Peerally Law Group stating that their approved I-140 have been revoked. I-140s are usually revocable before the I-1485 was filed and 180 days have not passed or revoked by the government for fraud! Many because of academic credentials do not meet the EB2 category. We want to hear from you, if this is the case...

      I never heard of revoking I-140 when it is approved>don't think it is possible

            Today again seems the USCIS is not leaving people alone with EB issues and employment. We just found out that someone who went for a citizenship interview, was asked proof that this person worked for the petitioning company. It seems they will always check.

              my friends sister went for citizenship interview and now they are asking her to prove she worked for the company who filed for her GC. she actually never worked - now she is worried of not only losing the citizenship but also the gc

                My current employer's EB2 I-140 was approved in Apr 2011. Two months back, my current employer's law firm informed that they received a NOIR for I-140 as well as LC from USCIS with a 30 day response time. They finally revoked it even after sending the NOIR response along with all W2, paystubs, experience letters from intermediate vendors and tax returns.

                The USCIS reasoning is that they doubt the veracity of one of the employment letters submitted which turns out to be from one of my old employers (consulting) who recently pled guilty in federal court to defrauding the government in relation to H-1B filings. And they also doubt my statement on the Labor Certification concerning my employment with this old employer.

                But the point is I was not involved in any wrong doings. I had maintained legal status at all time and all my stated experience is genuine

                  This is really sad. Yesterday we had a situation where the employer actually revoked the I-140 and although there was an I-485 filed and 180 days had passed (Under AC21), they told the candidate his underlying I-140 is denied and therefore I-485 was denied. Now he has to file a motion to reopen to be able to clear this although he was not at fault. Good Luck

                    Well My present company's DB4 I-110 was accepted in Dec 2011. Two several weeks returning my present company's law company advised, that they obtained a noir for I-110 as well as AC from US with a 20 day reaction time.
