  • GC Priority date retention

    Hi Shah,

I was wondering if you can help me with this query:

I have got an approved I-140 from my current employer.
I am wondering if there is a cooling period after I-140 approval before I can carry forward the priority date if I choose to switch to a different employer.
This is assuming the job with the new employer will be of similar nature to my current job.

I am to believe that the new employer will have to do a new PERM and I-140 anyways. But I am keen to know if there are any cooling period involved before I can claim to retain my priority dates from the previous I-140.

    Please advise.

    Thanks,
    Sam

    Hi,
There is no "cooling off period". However if you are moving while beyond 6th year, you better make sure the i140 is not withdrawn before you move. Call us at 5107425887 and we shall be glad to assess.
