  • Question about re-entry and Kids green card

    My Brother and his family received Green card (sponsored by me) in 2010. They lived here for 8 months and then went back. They had applied and received two year re-entry permit. As my brother is quite old he does not plan to come back but would like his two kids (age 18 and 12) to retain their green cards (F4). Can kids come in alone using their re-entry permit? They still plan to finish their schooling India so they will come to USA every year to retain their Greencard. IS that OK or does my brother also has to retain his greencard? --- Thanks SG007.

    I had a similar situation back in the days. The action of the parents are usually imputed to the children. However, if the children come here and stay, they should be able to keep their greencards. The 18 old is an adult, he does not need any guardianship. But you might need guardianship.
