Family based Strokes interview Denied

  • Family based Strokes interview Denied

    My friend his name is Ahmed from Egypt, His first marriage with US citizen didn't worked during the interview. the officer asked his first wife to withdraw i130 sponsorship, which she did it.
    he was put in removal proceedings. He applied for divorce.
    After that he got married to second wife US citizen and applied for adjustment of status again, during the master hearing Hon Judge ordered strokes interview.
    Immigration agents went to Ahmed's second wife's mom's house and his place of residence, enquired his neighbours, etc lot of ground work before strokes interview.
    During storkes interview, He was separated from his wife and interviewed for 1 and half hours, After the interview, they found that both gave different answers and denied the i130 petition and gave him 3 choices,
    1. 30days to leave country.
    2. volantary depature,
    3. fight deportation case.
    He is right now in dilema what to do, any advise appreciated.

    Unfortunately this is what your friend will be facing:

    1. Ahmed will have to prove that his first marriage was bona fide - which means was entered in good faith and unless he can prove this, any subsequent marriages will not be considered.
    2. If he is genuinely married, he can still fight the case, but the first marriage will always be an obstacle. One of the ways is to take a voluntary departure and petition from outside. But again the first marriage might be a bar.

    Such cases are difficult to win unless more information is provided and the attorney can prove both marriages are bona fide. Which is usually not the case.

      They went back and requested the officer again, He may possibly consider to get 1 more interview or possible raids at his home , he said that he is re considering to file for 1 more i130 petition, I advised about your name and gave your details to my friend also.

        All that happened for the lacking of knowledge about family law, if you are going to face any situation like this where you feel now you can't handle or manage all the stuff the best way is immediately consult your lawyer who has all the expertise of tackling worst situations.

          I think you must be aware of all the laws and obstacles that comes in your way before going to marriage.Most of the people have same problem because they trying to be smart but after that they have to face legal action for that.I think you must consult with your immigration lawyer first that what to do for getting marriage.

              I think you must be aware of all the laws and obstacles that comes in your way before going to marrige .Most of the people have same problem the stuff the best way is immediatly consult your lawyer.

                I think you are absolutely right refinancetoolbox ,better to consult with lawyer before going to get married with any girl and also grasp some knowledge about these laws by our self also helps to keep away from this kind situation.
