    Adjustment of Status Based on U Visa - My Journey

    Hi Guys, I started my journey to AOS based on U visa in march 2019. I'd like to keep everyone posted on my progress. Please share your experiences if you have a pending AOS based on U Visa.

    DOCUMENTS NEEDED FOR MY AOS:
    -copy of birth certificate
    -copy of every page of my valid passport for the last 3 years
    -copy of work permit
    -copy of U visa approval notice
    -6 passport photos (2 for I-485, 2 for I-765 & 2 for I-131 forms)
    -sealed medical exam
    -documents showing continuous presence for 3 years
    -declaration regarding lack of request for ongoing assistance to law enforcement
    -declaration regarding why this adjustment of status should be granted under discretion
    -check for $1225.00

    I got married after my U visa was approved. My wife overstayed her visa, so I petitioned for her by filing form I-929 along with my AOS.

    DOCUMENTS NEEDED FOR I-929 FOR A U-1 FAMILY MEMBER:
    -copy of marriage certificate
    -copy of her birth certificate
    -1 passport photo
    -Letters from family and friends in the U.S.
    -Declaration by me, U-1 visa holder
    -declaration by my wife
    -check for $230.00

    These are the documents we sent with our applications. I will keep everyone posted on our progress in the next post.

    Hi guys, it's me again. Here is my timeline so far:

    03/05/19: Mailed forms I-131, I-485, I-765, and I-929
    03/08/19: Case received by USCIS
    03/18/19: Got receipt notices for all the forms filed
    04/08/19: Got U visa extension notice that extends U status until a decision is made on I-485
    04/08/19: Received biometrics appointment notice
    04/19/19: Biometrics appointment
    04/19/19: Status on I-765 changed to "fingerprint review was completed"
    04/25/19: Status on I-485 changed to "fingerprint review was completed"
    05/14/19: Status on I-765 changed to "card in production"
    05/16/19: Status on I-765 changed to "card was mailed to me"
    05/20/19: Received approval notices for I-131 & I-765
    05/21/19: EAD/AP combo card received.

    they approved my work permit and advance parole card much faster than I was expecting. On USCIS case status online it still says case received for my advance parole form I-131. But I already have the card on hand. I hope it helps. Please share your timeline if you have a pending AOS based on U visa. Thanks!

    I applied in May 2019 for U visa.
    If all your process was so fast is good! They told me that it can take up to 4-5 years!

    My U visa process was quite the wait, there were so many obstacles along the way but in the end we were victorious. Below is my timeline when I first applied for the U visa:

    03/12/2012 - Case received
    04/16/2012 - Biometrics appointment
    May / 2013 - RFE
    June/ 2013 - RFE responded
    May / 2014 - My lawyer sent an inquiry into the case regarding why it was taking so long
    July / 2014 - USCIS acknowledged that the case fell out of the normal processing time and told us that we would soon hear a decision
    09/05/2014 - U VISA DENIED
    10/02/2014 - Appealed the denial
    03/04/2015 - DA granted and placed on waiting list
    March/2015 - Applied for EAD card
    May / 2015 - EAD card received valid for 2 years
    11/15/2015 - U visa status granted and a new EAD card valid for 4 years received.

    It has been quite a journey and i can't wait for it to be over.

    May I ask what did you apply for U visa and why it was denied? You can write in private if you like?

    There was a problem with my I-918 Supplement B, U Nonimmigrant Status Certification. When I first applied for U visa it was still a new thing in my city and our local law enforcement, the ones who investigated the crime, were not signing any certification of helpfulness. We had a very hard time getting the certification and after several unsuccessful attempts my attorney sought a higher authority. My attorney contacted the state police. A state police officer looked into the case and signed the certification of helpfulness. USCIS, however, was not happy with that and denied the U visa stating that the officer was not authorized to sign the certification because he was not involved with the investigation.
